Tiivistelmä

The purpose of this essay is to evaluate the effectiveness of the principle of mutual recognition as a method of integration of the single market. This essay focuses on the free movement of goods, and the most relevant advantages and disadvantages that the principle of mutual recognition has been found to have after it was first introduced in the 1970’s. The method of this study is theoretical, and it is mainly based on Catherine Barnard’s book The Substantive Law of the EU – The Four Freedoms (4th edn, Oxford 2013), as well as the European Commission’s reports and evaluations on the application of the principle of mutual recognition. In order to give the reader a more comprehensive view of the topic, the essay also covers the most well-known alternative method of integration, which is harmonization at the Union level. The essay concludes that the principle of mutual recognition has still not reached its full potential. Some of the main issues include companies’ lack of knowledge of the application of the principle, and Member States’ unwillingness to allow goods produced according to foreign standards to their market. Based on the results of this study, it seems that for the time being, harmonization remains a more effective method of integration.
