The Right to Clean Air: Implementing the Air Quality Directives of the European Union

The article in concerned about the Air Quality Directive of the European Union (directive 96/62/EC) which introduces an area-oriented strategy of reducing and limiting ambient concentrations of air pollutants which has to be implemented through implementation plans or programmes and action plans, in the case of ozone and some carcinogenic air pollutants through less stringent programmes. The change in the air pollution control strategy mandated by the air quality directives of the EU causes significant adjustment problems. It raises difficult legal questions, especially as to the legal nature of the ambient quality standards and the extent to which the new standards accord affected citizens a right to clean air.
