Tiivistelmä

This article is about a doctoral dissertation that critically examines the regulatory potential of the constitutional right to a healthy environment in response to corporate environmental damage in Kenya. Corporate actors have been associated with some of the most challenging environmental problems around the world, such as climate change, biodiversity loss and egregious incidences of pollution. Corporate actors present unique regulatory challenges to the state primarily because their fictional character imbues them with the ability to resist the force of state-backed law.

The nature of corporate environmental damage places a demand on States to identify and adopt effective regulatory responses. One of the ways that states have responded to this demand is by adopting the right to a healthy environment. Presently, the right can be found in the laws of many countries around the world where it is formulated either as a constitutional human right, a constitutional principle of governance or as a statutory norm.
