According to the 2015 version of the World Anti-Doping Code (“WADC”), intentional anti-doping rule violations (“ADRV”) based on the presence of a prohibited substance in an athlete’s sample, the use or attempted use of a prohibited substance, or the possession of a prohibited substance are sanctioned with a four-year ineligibility period. The article explores the established practice of the Court of Arbitration for Sport (“CAS”) in cases related to anti-doping rule violations. Generally speaking, the practice has been that in order to be entitled to a finding of unintentional violation, the athlete must establish, on the balance of probabilities, how the substance in question came to be present in their system. Lately, the CAS has refined this approach in three arbitral awards. The rulings are examined in the article. (Edilex-toimitus)
