Data Exclusivity in the European Free Trade Agreements and Access to Medicine in the Developing Countries

Tiivistelmä

The purpose of this thesis is to explore data exclusivity and its impact on access to medicine in the developing countries. In particular, the focus is on the bilateral agreements that the European Union is pursuing. The question posed is how the data exclusivity clauses in FTAs concluded between EU and the developing countries affect access to medicine. Some alternatives to data exclusivity are also pondered. The “global drug gap” and the confrontation between the rich and the poor, the North and the South, are some of the main narratives throughout the thesis. Nevertheless, the focus is on the EU’s bilateral agreements with the developing countries. These agreements are analysed primarily by using juridical method and policy analysis.
