Opponent’s Statement on Daria Kozlowska-Rautiainen’s Dissertation: Obtaining Documents from the Opponent in International Commercial Arbitration

This dissertation is the first academic dissertation devoted to production of documents. As the bibliography in the dissertation illustrates, much has been written about production of documents over the years. Most of such writings are, however, in the form of articles and comments on various forms of guidelines. The dissertation is the first in depth scholarly treatment of this area of international arbitration. It is particularly important and relevant since there is no international convention, or other international instrument, nor municipal legislation which governs the question of production of documents in international arbitration. There are, however, several guidelines which deal with this issue, in particular the IBA Rules on the Taking of Evidence in International Commercial Arbitration. The dissertation is an interesting contribution to the analysis and understanding of this form of soft law sources. (Edilex-toimitus)
