Review of Nordic Mergers in Light of the Three/O2 Decision

In May 2020, the European Union General Court (“General Court” or “Court”) annulled the European Commission’s (“Commission” or “EC”) prohibition of Three’s acquisition of its telecom rival O2 in the UK. In its decision, the Court clarified the conditions necessary for a competition authority to prohibit a merger and reminded the Commission about the standard of proof in merger cases.

The authors analyse the Court’s reasoning in the Three/O2 case from an economic perspective. They will take a Nordic perspective, as they review the potential impact of the Court’s decision on the Nordic competition authorities’ merger investigations.
