Bankruptcy and Dispute Resolution in the International Commercial Arbitration Court at the Chamber of Commerce and Industry of the Russian Federation

Frequently, concurrent proceedings may be pending in international commercial arbitration and a national court – generally that of the respondent. This results in a conflict between the public legal method of resolution of the respondent’s bankruptcy case and the private legal method of dispute settlement in international commercial arbitration between such respondent and the claimant. International arbitration centers have not yet taken a common stand on this matter; however one may speak of a prevailing trend in this respect. This article concentrates on the International Commercial Arbitration Court at the Chamber of Commerce and Industry of the Russian Federation.
