Tiivistelmä

The principle audiatur et altera pars lacks a sufficiently established translation into English, but has been referred to as the adversarial principle or the principle of contradiction. The adversarial principle applies also in arbitration. The parties to an arbitration cannot effectively agree that the arbitrators may decide the matter without having given both parties the opportunity to plead their case. This article examines, whether the adversarial principle in practice actually is duly adhered to and respected in arbitral proceedings.
