Tiivistelmä

In the article the duties and obligations of private parties are mentioned only in passing; the emphasis is on the genesis of genuine Community rights via the theory of direct effect. The ECJ has put the burden of guaranteeing the fulfillment of these rights by corresponding obligations on Member states, if private parties could not be held liable despite Community law requirements. The main thrust of the article can be found in insisting on the emergence of a »third stage», namely horizontal liability of private persons within the scope of application of EC law.
