In this article it is not provided a legal analysis of the two European court cases Viking Line and Laval. Article provides some political and practical insight to the two decisions from the trade union point of view. First, collective actions by trade unions are now made subject to the ‘objective justification’ and proportionality test. Trade union activities are made subject to Art 43, 49 and 50 EC, in other words these articles have a horizontal direct effect in relation to trade union activities in member states. Secondly, trade union actions constitute a restriction on the freedom to provide services and on the freedom of establishment but are justified under certain circumstances.
