Laval and Viking Line at a first glance

Article analyses two recent European court cases. The ECJ’s decisions in Viking Line1 and Laval2 are wide ranging and far reaching. Court’s opinion commences with a discussion of the Posted Workers Directive and the Swedish implementation of this Directive. PWD has a dual objective. It is primarily concerned with clarifying which terms and conditions of employment may be imposed by a host state. The conflict of laws dimension follows from, but hence is secondary, to this. Secondly, The crucial issue in Laval, as in Viking Line, was whether Community law could provide a basis for bringing a claim directly against the trade union(s) concerned. It is settled law that a directive cannot have horizontal direct effect.
