Multimodal Transport and Jurisdiction under Article 5(1)(b) of the Brussels I Regulation

The Court of Justice of the European Union (CJEU) has on several occasions in the past dealt with international jurisdiction with regard to international carriage of goods. However, the first case to concern multimodal carriage and application of the provisions on special jurisdiction of Article 5(1)(b) of Council Regulation (EC) No

44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (Brussels I Regulation) was decided in July 2018 (Zurich v Abnormal Load).

The purpose of this paper is to analyse and comment on the contents of the judgment in the light of previous judgments of the CJEU regarding interpretation of Article 5(1)(b) of the Brussels I Regulation. Comments will also be made on the implications of this judgment for multimodal transport, on the relevance of conventions on particular matters, and on

prorogation of jurisdiction.
