Social Justice in European Private LawMicklitz, Hans-Wolfgang
JFT 2018/1 s. 27
The believers into the social dimension of Europe seem to belong to a minority. However, the article argues that European private law is guided by a genuine European model of justice called access justice, which differs from social distributive justice, but which is still to be regarded as a thin version of social justice. In its participatory form it even turns into societal justice. The article also has a short look into the triple transformations of private law, the nation state and social justice, in order to be able to locate access justice and societal justice.
