This article outlines the various criticisms of the investor-state dispute settlement (ISDS) mechanism expressed in recent years by a variety of academic and non-academic commentators. The writer explains why the ISDS mechanism, a standard part of bilateral investment treaties (BITs), has come under such heavy fire and also explores in detail the contents of ISDS provisions found in BITs to which Finland is party.
