Article 71 of the Council Regulation (EC) 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (Brussels I Regulation) plays an important role for any lawyer dealing with international disputes concerning maritime and transport law matters. Although some of the transport law conventions also contain provisions on jurisdiction and enforcement of judgments, others only contain provisions on jurisdiction, while some lack all such provisions. It is of fundamental importance to know which provisions on jurisdiction and enforcement are applicable in a specific case: those of the Brussels I Regulation or those of a transport law convention, a so called convention on a particular matter.

This article deals with the interpretation of the relationship between Article 71 of the Brussels I regulation and transport law conventions containing provisions on jurisdiction and recognition and enforcement of judgments in the light of three judgments of the European Court of Justice.
