Individual, consensual market transactions are a prerequisite for a functional copyright theory based on exclusive rights; if one cannot conclude these transactions, the basic material interests of authors cannot be secured. The article evaluates the extent to which it is possible to conclude transactions between prosumers (who are understood as private natural persons using expressions for non-commercial purposes) and right holders as it pertains to use of content over the Internet. The article first evaluates copyright from a theoretical perspective and thereafter examines practical possibilities to conclude transactions. The evaluation regarding practical possibilities is conducted from the viewpoint that those who attempt to conclude relevant transactions are natural persons. As rights of prosumers must be secured in a similar manner to the rights of authors, this article concludes that alternative means should be used to secure the right to science and culture and rights of authors pertaining to the use of content on the Internet.
