Tiivistelmä

The Lisbon Treaty has brought about fundamental changes to the structure of the EU. One of the most important changes is the conversion of the Charter on Fundamental Rights of the European Union into a legally binding "bill of rights" for the EU. Since the Charter has become legally binding, discussion has arisen concerning the Charter’s scope of application. This article focuses on the implementation and application of the Charter, in other words what Article 51 regulating the scope of application of the Charter signifies in practice, and the role of the European Court of Justice (CJEU). This article includes an examination of the background of the Charter followed by a presentation of important case law of the CJEU, and finally an analysis of theoretical problems concerning e.g. terminology when interpreting the Charter and the role of the CJEU. The article finishes with brief conclusions. (Edilex-toimitus)
