Tiivistelmä

Today there seems — at least in most parts of the world — to be a general consensus on the desirability of a concentrated and primarily oral trial before the ultimate trier of fact with all the evidence "freely evaluated". Especially in the proof-taking stage comes an emphasis on the "immediacy" and "concentration" — so that the trier of fact can hear, assess and compare the actual oral evidence. With these aspirations a special attention must be paid to the preparatory stage of the proceedings. This article examines the pre-trial procedure in civil matters from a primarily Scandinavian perspective. (Edilex-toimitus)
