How absolute is absolute? – On the limits of Article 3 of the European Convention on Human Rights in the context of immigration control

This paper focuses on the limits of the absoluteness of Article 3 of the ECHR in the context of immigration control through analysing the relevant practice of the ECtHR. It seeks to make these limits visible through three examples. The first example concerns the significance of the individual’s age in the assessment on whether her treatment amounts to ill-treatment. The second example discussed below concerns the significance to be attached to the individual’s own conduct when assessing whether her treatment would fall within the ambit of Article 3. The last example concerns cases where the suffering encountered by the individual upon her removal would result from her poor health combined with the lack of medical and other care in the country where she would be deported to.
