The stories we tell ourselves – about Nordic law in specific

Tiivistelmä

In this paper the Nordic law is discussed specifically but it also serves as an example of typical macro-construct of modern comparative law. Husa sees a new challenge to the traditional democratic theory in the case of systems moving towards rule by judges instead of rule by parliamentarians.

Husa also discusses that in Nordic countries it is accepted that the most important decisions in the public sphere should be made by elected politicians. This is not the role of the courts. He estimates that even if the role of the courts is to stay away from political decisions the human rights are still well protected.
