Tiivistelmä

The article is a case analysis of this relatively recent CJEU UsedSoft decision. It looks at the case from the EU law perspective and more specifically from the principle of free movement of goods perspective. The article gives an overview of the tradition of the Court’s application of copyright provisions in cases where also free movement of goods aspects have been present. The Court of Justice of the European Union’s (CJEU) decision in UsedSoft GmbH v Oracle international Corp, C-128/11 surprised many. It was the first case where the Court decided that according to European Union legislation, sales of digital copies of second hand software may, under certain circumstances, be lawfully sold further. The major reason to why the decision was surprising was because a court in the United States had in a similar case to the UsedSoft case ended up in a different conclusion.
